Australia issued a formal notification withdrawing entitlements to the Most-Favoured Nation (MFN) tariff treatment and will, from 25 April 2022, apply an additional tariff of 35% to all imports from Russia and Belarus. This will be in addition to general duty rates that currently apply. The duty in respect of additional duty goods is: (a) if the general rate set out in the third column of the tariff classification under which the goods are classified is ‘Free’, the amount of duty in respect of those goods is an amount equal to 35 % of the value of the goods; (b) if the general rate set out in the third column of the tariff classification under which the goods are classified is not ‘Free’, the amount of duty in respect of the goods would be calculated by adding an amount equal to 35 % of the value of the goods to the general rate. Goods are considered additional duty goods if they are the produce or manufacture of Russia or Belarus and are imported into Australia within a specified timeframe. The additional duty will apply to goods that are either imported into Australia during the period beginning on 25 April 2022 and ending at the end of 24 October 2022, or imported into Australia before 25 April 2022, where the calculation of the rate of import duty occurs during that 6-month period. The additional duty will apply for 6 months and goods cannot simply be warehoused during that timeframe to avoid the additional duty. Goods will be the produce or manufacture of Russia or Belarus if: (1) the goods are unmanufactured raw products of Russia or Belarus; or (2) the last process in the manufacture of the goods was performed in Russia or Belarus, Minimal operations or processes, such as changing packing or breaking up or assembly of packages, that occur outside of Russia or Belarus are taken not to be a process in the manufacture of the goods. There is an exemption for goods originating in Russia and Belarus that have completed Russian or Belarusian export formalities and left those territories before 25 March 2022. This exemption relates to the goods on which additional duties were applied on 25 March 2022.

On the 3rd of March 2022, the Federal Government announced, that in light of the ongoing Russian invasion of Ukraine and the continuing escalation of sanctions imposed against Russia in response, that it has strong expectations that Australian superannuation funds will review their investment portfolios and take steps to divest holdings in Russian assets. The Financial Services Council (FSC) supports the Federal Government’s expectation that the superannuation industry divests Russian assets as part of broader global economic sanctions to address the humanitarian crisis in Ukraine. The FSC acknowledges the close integration of superannuation and non-superannuation investment assets, as such the FSC has developed this for both superannuation trustees and fund managers, that invest capital directly or indirectly on behalf of superannuation trustees, to meet the Government’s expectations.
