Technology and dual-use goods
The EU included a new category of goods in Annex VII, titled “miscellaneous”, thereby designating the products listed therein as products that might contribute to Russia’s military and technological enhancement, The newly included products include, equipment for oil production and oil exploration, equipment, “electronic assemblies” and components, microscopes, related equipment and detectors, collector equipment for metal ores in deep seabed, manufacturing equipment and machine tools, equipment for the “production” of printed electronics for organic light emitting diodes (OLED), organic field-effect transistors (OFET) or organic photovoltaic cells (OPVC), “cryogenic refrigeration systems”, specially designed for quantum computers, “decapsulation” equipment for semiconductor devices, numerical controlled machine tools, metal powders and metal alloy powders, advanced materials, and conjugated polymers (conductive, semiconductive, electroluminescent) for printed or organic electronics, advanced semiconductors, energetic materials, high-end electronics, software etc. Посилання на оригінал

Prohibition on providing access after 16 April 2022 to EU ports to vessels registered under the flag of Russia as well as to vessels that have changed their Russian flag or their registration to the flag or register of any other State after 24 February 2022. An exception is provided for in the event of a vessel in need of assistance seeking a place of refuge, of an emergency port call for reasons of maritime safety, or for saving life at sea.
Member States may authorise access for a vessel under certain specific circumstances, including in relation to the purchase, import or transport into the EU of (a) natural gas and oil, including refined petroleum products, and certain metals (titanium, aluminium, copper, nickel, palladium and iron ore), chemical and iron products (as listed in Annex XXIV to the EU Regulation), (b) pharmaceutical, medical, agricultural and food products, including wheat and fertilisers whose import, purchase and transport is allowed under this Regulation, (c) for humanitarian purposes, (d) nuclear fuel and other goods strictly necessary for the functioning of civil nuclear capabilities, (e) until 10 August 2022, coal and solid fossil fuels.

Such prohibition does not apply for mail services, nor for goods in transit through the EU between the Kaliningrad Oblast and Russia, if otherwise not prohibited.

Member State may authorise the transport of goods by a road transport undertaking established in Russia for: (a) the purchase, import or transport into the EU of natural gas and oil, including refined petroleum products, as well as titanium, aluminium, copper, nickel, palladium and iron ore; (b) the purchase, import or transport of pharmaceutical, medical, agricultural and food products, including wheat and fertilisers whose import, purchase and transport is allowed under this Decision; (c) humanitarian purposes; (d) the functioning of diplomatic and consular representations of the EU and of the Member States in Russia, including delegations, embassies and missions, or international organisations in Russia enjoying immunities in accordance with international law; (e) the transfer or export to Russia of cultural goods which are on loan in the context of formal cultural cooperation with Russia.

Prohibition on the award or continued execution of public procurement contracts to Russian nationals, legal person entities or bodies established in Russia, their majority-owned subsidiaries or any persons acting on their behalf or at their direction. Russian companies are banned from EU public procurement procedures covered by the EU Public Procurement Directives as well as most public contracts and concessions that are subject to exceptions from these directives. The restriction covers both new contracts but also the continued execution of existing contracts, which will not be allowed after 10 October 2022 of contracts concluded before 9 April. The ban also extends to subcontractors, suppliers and other entities whose capacities are being relied on, if they account for more than 10% of the contract value. Посилання на оригінал

the competent authorities may authorise the award and continued execution of contracts intended for:
(a) the operation, maintenance, decommissioning and radioactive waste management, fuel supply and retreatment and safety of civil nuclear capabilities, and the continuation of design, construction and commissioning required for the completion of civil nuclear facilities, as well as the supply of precursor material for the production of medical radioisotopes and similar medical applications, critical technology for environmental radiation monitoring, as well as civil nuclear cooperation, in particular in the field of R&D;
(b) intergovernmental cooperation in space programmes;
(c) the provision of strictly necessary goods or services which can only be provided, or which can only be provided in sufficient quantities, by the persons referred to in paragraph 1;
(d) the functioning of diplomatic and consular representations of the EU and of the Member States in Russia, including delegations, embassies and missions, or international organisations in Russia enjoying immunities in accordance with international law;
(e) the purchase, import or transport of natural gas and oil, including refined petroleum products, as well as titanium, aluminium, copper, nickel, palladium and iron ore from or through Russia into the EU;
(f) the purchase, import or transport into the EU of coal and other solid fossil fuels until 10 August 2022,

EU export restrictions were expanded significantly to cover a wide range of products, which could contribute in particular to the enhancement of Russian industrial capacities, as listed in Annex XXIII. This Annex includes more than 500 products, including numerous chemicals and chemical preparations (such as hydrogen, nitrogen, oxygen, silicon, arsenic and many more chemicals, substances and products, specialist catalysts for use in the refinery industry), paints/inks, rubber products, wood and paper products, textile-related items, building materials, glass products, iron/steel/copper/aluminium items, various tools, numerous kinds of and machinery, motors and electronic/electrical appliances, heavy duty and special purpose vehicles, seats for aircraft/motor vehicles, surveying equipment, and many more. Their direct or indirect sale, supply, export or transfer to parties in Russia or for use in Russia, as well as related services, are now generally forbidden. *** It shall be prohibited to sell, supply, transfer or export, directly or indirectly, goods which could contribute in particular to the enhancement of Russian industrial capacities as listed in Annex XXIII, to any natural or legal person, entity or body in Russia or for use in Russia. 2. It shall be prohibited to: (a) provide technical assistance, brokering services or other services related to the goods and technology referred to in paragraph 1 and to the provision, manufacture, maintenance and use of those goods and technology, directly or indirectly to any natural or legal person, entity or body in Russia or for use in Russia; (b) provide financing or financial assistance related to the goods and technology referred to in paragraph 1 for any sale, supply, transfer or export of those goods and technology, or for the provision of related technical assistance, brokering services or other services, directly or indirectly to any natural or legal person, entity or body in Russia, or for use in Russia. Goods which are necessary for the official purposes of diplomatic or consular missions of Member States or partner countries in Russia or of international organizations enjoying immunities in accordance with international law, or to the personal effects of their staff, are exempted from these new prohibitions. In addition, the EU Member States can authorise supply and related services for humanitarian purposes.

Prohibition on the purchase, import, or transfer, directly or indirectly, of a wide range of goods which generate significant revenues for Russia (as listed in Annex XXI), into the EU originating in, or exported from, Russia. The new goods and technology listed in Annex XXI, include, inter alia, wood, cement, phenols, chloride, fertilizers, wood, glass products, rubber products, various chemicals, silver, aluminium, liquor products, seafood (including caviar), spirits (including vodka). With respect to the listed fertilisers (including potassium chloride), limited imports will continue to be allowed after 10 July 2022 subject to an annual tariff-rate quota ((a) 837 570 metric tonnes of potassium chloride of CN 3104 20; (b) 1 577 807 metric tonnes combined of the other products under CN 3105 20, 3105 60 and 3105 90) between 10 July 2022 and 9 July 2023. The import volume quotas will be managed by the European Commission and the EU Member States.

European Commission adopted the “Guidance to the Member States concerning foreign direct investment from Russia and Belarus in view of the military aggression against Ukraine and the restrictive measures laid down in recent Council Regulations on sanctions”. Among others, the document calls on EU Member States to: (1) Systematically use their screening mechanisms to assess and prevent the threats related to Russian and Belarusian investments on grounds of security and public order; (2) Ensure close cooperation between national authorities competent for sanctions and those competent for the screening of investments in the context of implementing EU sanctions, as well as identifying breaches and imposing penalties; (3) Implement fully the FDI Screening Regulation to address risks related to security or public order related to FDI from Russia and Belarus; and (4) Ensure full compliance with the requirements of the Anti-Money Laundering Directive to prevent the misuse of the EU financial system.
