UK widened an existing prohibition on providing technical assistance to designated persons in relation to aircraft in Belarus to include technical assistance provided in relation to ships. The current aircraft restrictions were widened so that it will now be an offence for certain Belarus-related aircraft to land in, or overfly, the UK, and for such aircraft to be registered in the UK. UK also gave the Secretary of State power to direct an airport operator to detain a Belarusian aircraft as well as provided the possibility to require refusal of applications for registration, or termination of existing registration, of aircraft owned by designated persons. Conditions relating to the exercise of the power of the Secretary of State to designate persons under the standard procedure and the urgent procedure, which was introduced by the Economic Crime (Transparency and Enforcement) Act 2022, are set out. Prohibitions do not apply to the sale, supply, making available, transfer or export of such goods and technology, or to the related provision of technical and financial services, funds and brokering necessary for (a) non-military use for a non-military end-user; (b) humanitarian assistance activity; (c) addressing a health emergency; (d) the urgent prevention or mitigation of an event likely to have a serious and significant impact on human health and safety or on the environment; or (e) providing a response to a natural disaster.

Amendment applies existing measures on ‘Restricted Goods’ and ‘Restricted Technology’ to "quantum computing and advanced materials goods and technology" listed in Schedule 2E, prohibiting the export, supply and delivery, making available and transfer of such items to, or for use in, Russia. Schedule 2E lists various equipment and components including (among others): cryogenic refrigeration systems, ultra-high vacuum equipment, microscopes, and certain types of manufacturing equipment. Regulations 5, 6 and 7 provide for licensing and exceptions from the new restrictions, by amendments to Part 7 of the 2019 Regulations.

*** Prohibitions do not apply ro (a) the personal effects of a person travelling to Russia, (b) of a non-commercial nature for the personal use of a person travelling to Russia and contained in that person’s luggage, or (c) necessary for the official purposes of a diplomatic mission or consular post in Russia, or of an international organisation enjoying immunities in accordance with international law.
Prohibitions do not apply to (a) consumer communication devices for civilian use, or (b) software updates for civilian use.

Trade restrictions on the provision of certain internet services and online media services to or for the benefit of designated persons (meaning persons designated for the purposes of this provision, and not necessarily all designated persons subject to an asset freeze). These measures apply to the whole territory of the UK and to conduct by UK persons where that conduct is wholly or partly outside the UK. The amending regulations introduce new regulation 54A of the 2019 Regulations which provides for a number of restrictions in the form of trade in services sanctions. The new regulations require that: - Social media services, including video sharing platforms, must take reasonable steps to prevent content that is generated, uploaded to or shared by a designated person being encountered by UK-based user. - Internet access services, including fixed and wireless broadband providers, must take reasonable steps to prevent UK-based users from accessing websites provided by a designated person. This will likely take the form of URL blocking. - Application stores, including those on smartphones, must take reasonable steps to prevent UK-based users from downloading or otherwise accessing an application provided by a designated person. Regulation 5 of the 2019 Regulations confers on the Secretary of State the power to designate a person for the purposes of new regulation 54A. Failure to comply with a requirement imposed under new regulation 54A is a criminal offence. The amendment regulation also confers additional powers to the Office of Communications (“OFCOM”) (the UK’s regulatory and competition authority for broadcasting and telecommunications) in relation to these restrictions, including the power to: (i) a person to provide information and documents for the purposes of monitoring compliance, and (ii) impose civil monetary penalties of up to £1 million on a person who fails to comply with the new trade sanctions. The designated entities or individuals ("Designated Persons") can be found on the regularly updated UK Sanctions List with the tag "Internet Sanctions List".
