Amendment applies existing measures on ‘Restricted Goods’ and ‘Restricted Technology’ to "quantum computing and advanced materials goods and technology" listed in Schedule 2E, prohibiting the export, supply and delivery, making available and transfer of such items to, or for use in, Russia. Schedule 2E lists various equipment and components including (among others): cryogenic refrigeration systems, ultra-high vacuum equipment, microscopes, and certain types of manufacturing equipment. Trade restrictions on the provision of certain internet services and online media services to or for the benefit of designated persons (meaning persons designated for the purposes of this provision, and not necessarily all designated persons subject to an asset freeze). These measures apply to the whole territory of the UK and to conduct by UK persons where that conduct is wholly or partly outside the UK. The amending regulations introduce new regulation 54A of the 2019 Regulations which provides for a number of restrictions in the form of trade in services sanctions. The new regulations require that: - Social media services, including video sharing platforms, must take reasonable steps to prevent content that is generated, uploaded to or shared by a designated person being encountered by UK-based user. - Internet access services, including fixed and wireless broadband providers, must take reasonable steps to prevent UK-based users from accessing websites provided by a designated person. This will likely take the form of URL blocking. - Application stores, including those on smartphones, must take reasonable steps to prevent UK-based users from downloading or otherwise accessing an application provided by a designated person. Regulation 5 of the 2019 Regulations confers on the Secretary of State the power to designate a person for the purposes of new regulation 54A. Failure to comply with a requirement imposed under new regulation 54A is a criminal offence. The amendment regulation also confers additional powers to the Office of Communications (“OFCOM”) (the UK’s regulatory and competition authority for broadcasting and telecommunications) in relation to these restrictions, including the power to: (i) a person to provide information and documents for the purposes of monitoring compliance, and (ii) impose civil monetary penalties of up to £1 million on a person who fails to comply with the new trade sanctions. The designated entities or individuals ("Designated Persons") can be found on the regularly updated UK Sanctions List with the tag "Internet Sanctions List". General Trade Licence authorises the direct or indirect provision of insurance and reinsurance services relating to aviation goods or aviation technology where insurance and reinsurance services are not being provided to a person connected with Russia. In the case of insurance services, authorization only applies where the Provider: (a) does not reinsure any of their obligations to provide those insurance services, or (b) reinsures any of their obligations to provide those insurance services and no such reinsurance cover has, as a matter of applicable law, been rendered unenforceable, suspended, frustrated or prohibited by any applicable sanctions. In the case of reinsurance (including retrocession) services, authorization only applies if the insurance obligations the Provider is reinsuring have not, as a matter of applicable law, been rendered unenforceable, suspended, frustrated or prohibited by any applicable sanctions. If the Provider is providing reinsurance services to a reinsurer, the reference to insurance obligations shall include the reinsurance obligations of reinsurer as well as the insurance obligations that reinsurer is reinsuring (and if there are more than two reinsurers above the Provider in a chain of reinsurance, shall also cover the reinsurance obligations of each such reinsurer). If the Provider is a reinsurer that has reinsured any of their obligations to provide those reinsurance services, authorization shall only apply if the reinsurance cover Provider has obtained has not, as a matter of applicable law, been rendered unenforceable, suspended, frustrated or prohibited by any applicable sanctions. Prohibition on the export, supply and delivery, making available and transfer of luxury goods (specified in Schedule 3A) to, or for use in, Russia or to a person connected with Russia. This also includes the direct or indirect supply or delivery of luxury goods from a third country to a place in Russia or make luxury goods available to a person connected with Russia or for use in Russia, but does not include the typical controls on related technical assistance, financial services, funds and brokering services. The full list of all luxury goods is set out in Schedule 3A of the UK Russia Regulations (subject to certain exceptions where goods are covered by other restrictions). That schedule specifies a sale price per item which is to be used in determining whether the goods in question fall within the restrictions. It is prohibited to export luxury goods with a sales price (excluding VAT) over £250 and vehicles (except for ambulances) with a sales price (excluding VAT) over £42,000 per vehicle. The specified 'luxury goods' are very broad ranging (high-end fashion goods, horses, truffles, clothes, vacuum cleaners, vehicles, works of art, pearls, semi-precious stones, and jewelry) so will cover a range of items that may not normally be thought of as luxury goods – save as a result of the value threshold.
